


INTRODUCTION TO OCAS SERVICES TO OMC's
OMC Compliance Advisory Services Limited (“OCAS”) has been set up to provide directors of Owner Management Companies
(“OMC’s”) with a readily accessible source of information and advice as to their obligations and responsibilities under the various legislation and regulations governing the operation of Multi-Unit Developments.
The Owner Management Company (“OMC”) is the entity responsible for managing and regulating a multi-unit development. Working in cooperation with the Managing Agent, the OMC through its directors plays a key role in creating a safe and attractive living environment for its owners and residents. A well run and well-maintained development not only enhances the quality of life for its residents, but also boosts the value of every owner’s property.
OMC’s are governed by the Companies Acts (principally the Companies Act 2014) and the Multi-Unit Development Act 2011 (The MUDs Act) which applies specifically to Multi-Unit Developments. The management of common areas (i.e. corridors, stairs, lifts, parking and amenity areas) as well water, sewage and fire alarms require an Onwer Management Company in the form of a Company Limited by Guarantee (CLG).
Simply put, an apartment development is made up of multiple living units and maybe some commercial units of which the OMC is the ultimate owner of the property. The owners of the individual units hold their title by way of a long term lease from the OMC, while the OMC remains responsible for the common areas and the services infrastructure which it manages for the benefit of the unit owners.
